Mendip Castors Terms and Conditions

Definitions

“Acceptance” means acceptance of the Order by email from the Seller to the Buyer confirming the Goods, the Price, payment details and delivery details

“Buyer” means the company, firm, body, person or otherwise purchasing the Goods

“Seller” means Mendip Castors Ltd, Unit 6 Anglo Business Park, Smeaton Close, Aylesbury, Buckinghamshire, HP19 8UP

“Goods” means the goods which the Buyer agrees to purchase from the Seller

“Price” means the price for the Goods (including VAT, where applicable)

“Order” means an order that is placed by the Buyer through the Website in respect of the Goods

“Website” means Mendip Castors website at www.mendipcastors.co.uk

Web Site Terms and Conditions of Sale of Goods

The terms and conditions set out in this document shall apply in respect of any sale of goods by the Seller to the Buyer and all other terms and conditions including any terms or conditions which the Buyer may attempt to apply under any confirmation or purchase order or similar document is and shall hereby be excluded

A variation to these Conditions shall not apply unless agreed to in writing by the Seller

Any Order received by the Seller from the Buyer is and shall be deemed to be an offer by the Buyer to purchase goods only under these Conditions

A Contract is formed between the Seller and the Buyer upon Acceptance by the Seller

An Order by the Buyer shall be conclusive evidence of the Buyer’s acceptance of these terms and conditions

Online Purchasing

Prices displayed for online products are purely for sale and delivery within the UK Only. Products on this website should not be purchased from outside the UK. We do however welcome enquiries from outside the UK, please use the Product Enquiries form to contact us with your requirements.

Invoices will be paid in Pounds Sterling. Delivery charges are based on delivery to UK mainland destinations. Products supplied according to the technical specifications shown. Mendip Castors policy of constant product improvement may lead to a change of source or manufacture or order code from time to time. To ensure that this does not cause any difficulties reasonable efforts will be made to inform buyers of any changes before supply.

Cancellation

In accordance with the Distance Selling Regulations 2000, the Buyer may cancel the Order up to 7 (seven) working days following delivery

Cancellations must be given in writing, by post, fax or email

If any Goods have been delivered, they must be returned to the Seller unused and in their original packaging to the following address:

The Price

The Price is the price that is published on the Web Site as at the time that the Order is placed

The Price is confirmed upon Acceptance

If there is a difference between the Price at the time that the Order is placed and the Price at Acceptance, the Seller will notify the Buyer as soon as reasonably practicable. The Buyer will have the right to cancel the Order in these circumstances (see Cancellation Clause)

Terms of Payment

Goods will be despatched to the Buyer upon full payment of the Price and the delivery charges

The Seller accepts payment by credit or debit card, including Visa, Mastercard, Maestro and Delta

Product Availability

Acceptance is subject to the availability of the Goods

In the event that any ordered Goods are not available, the Seller will notify the Buyer as soon as reasonably practicable after receipt of an Order

If the delay is prolonged or if the product is unavailable, the Seller shall refund the Price to the Buyer by crediting the credit or debit card from which the payment was taken as soon as reasonably practicable or within 30 (thirty) days

Product Liability

Mendip Castors liability is limited to the value of the products purchased and we accept no liability for incidental or consequential losses.

Shipping and Handling

When ordering please be aware of the following delivery charges that apply to all UK mainland destinations. Contact us for delivery costs if you need goods sent elsewhere and we will be happy to quote prices and delivery times for your specific requirements:

Dispatch method used is 24-hour (next working day) carrier.

Despatch

96% of orders for ex-stock items received and paid for by 12.30pm and for despatch to UK mainland destinations will be sent on the same day as the order is received (subject to payment being cleared). For non-UK mainland destinations see ‘Shipping and Handling’ above. Orders received after 12.30pm or at weekends will be despatched on the next working day.

Shortage, Damage and Non-Delivery

Short deliveries or damaged items must be notified to Mendip Castors within 48 hours of receipt. Non-delivery of goods must be reported to Mendip Castors within 5 days of dispatch date. Late claims cannot be accepted.

Returns

Mendip Castors want you to be pleased with your purchase. All returns must be approved by Mendip Castors who will issue you with a returns authorisation number. Telephone customer service on 01296 431135. You can return purchased goods to us within 10 working days of receipt, providing they are unused and in their original packaging. Outbound delivery charges will not be refunded and a restocking fee of 15% plus VAT may be charged. Credits will be processed against the same card the purchase was made on.

Lead Time Items and Back Orders

If your item is not available ex-stock or has a delivery lead time we will order it for you. You will receive confirmation of order details and lead times involved. If you are not able to wait for the indicated delivery period please cancel your order by telephoning Customer service on 01296 431135 or by return of email within 24 hours. If no cancellation notification or email is received we will assume that the lead time is acceptable and proceed with the order.

VAT

20% VAT will be added to orders placed from within the UK or European Union.
